Terms & Conditions
Benchspace is an inclusive space, where everyone is welcome to learn, create and collaborate. We want every user to have an enjoyable and fulfilling experience. To make this possible we expect all of our members, staff, teachers, contractors, students and visitors to be friendly and respectful towards each other. This applies to all of Benchspace’s physical spaces and events, as well as online communications and virtual activities.
We expect everyone to maintain an environment of respect, tolerance, encouragement and friendliness.
Benchspace has a clean as you go policy. You are expected to leave all shared areas, benches or equipment clean, tidy and safe for the next person to use. Put tools, equipment and your property back in its place when you are finished. Leave it as you would like to find it. Remember, Benchspace is a shared space - it takes a little work, to make it work for everyone!
Use of services.
- You agree that when participating, you will use the shared machinery on a fair usage basis and make every effort to cooperate with other users in accessing a particular item of equipment.
- You are expected to operate as an independent trader. You may not use Benchspace logos, order forms, letterheads or other forms of Benchspace identification or in any way give trade suppliers or other commercial parties the understanding or impression that you are representing or acting as an agent for Benchspace
- You are expected to provide your own personal hand tools.
- You are required to adhere to Benchspace health and safety measures. Products or equipment that breach health and safety standards in the building are prohibited.
- Access to the workshop and equipment is restricted during Classes and events. Please see Benchspace Calendar (http://benchspacecork.ie/calendar/) for advance notice. However, if for some reason you need to access the space during these times, please contact the Operations Manager in advance and you will be accommodated.
Participation in or Use of Services.
- You acknowledge that you are participating in or using the services at Benchspace of your own free will and decision. You acknowledge that Benchspace does not have any liability with respect to your access, participation in, use of the services, or any loss resulting from such participation or use.
Disclaimer of Warranties.
- To the maximum extent permitted by applicable law, Benchspace provides the services “as is” and with all faults, and hereby disclaim with respect to the services all warranties and conditions, whether express, implied or statutory. The entire risk as to the quality, arising out of participation in or the use of the services, remains with you.
Exclusion of Incidental, Consequential and Certain Other Damages.
- To the maximum extent permitted by applicable law, in no event shall Benchspace or its past, present and future officers, agents, members, representatives, employees, successors and assigns, jointly or individually be liable for any direct, special, incidental, indirect, punitive, consequential or other damages whatsoever (including, but not limited to, damages for: loss of profits, loss of confidential or other information, business interruption, personal injury, loss of privacy, failure to meet any duty (including of good faith or of reasonable care), negligence, and any other pecuniary or other loss whatsoever) arising out of or in any way related to the participation in or inability to participate in or use of the services, the provision of or failure to provide services, or otherwise under or in connection with any provision of this agreement.
Termination.
- One months notice is required to cease your membership.
- Benchspace reserves the right to terminate any service at any time. Benchspace further reserves the right to terminate your participation in and use of any services, immediately and without notice, if you fail to comply with the TOU. Benchspace may terminate this agreement for any or no reason with the serving of one month’s notice. The client may also terminate this agreement by giving one month’s notice in writing.
- Indemnification.
You release, and hereby agree to indemnify, defend and save harmless Benchspace and its past, present and future officers, agents, members, representatives, employees, successors and assigns, jointly and individually, from and against all claims, liabilities, losses, damages, costs, expenses, judgments, fines and penalties based upon or arising out of your negligent actions, errors and omissions, willful misconduct and fraud in connection with the participation in or use of the services.
- Severability.
In the event that any provision or portion of this TOU is determined to be invalid, illegal or unenforceable for any reason, in whole or in part, the remaining provisions of this TOU shall be unaffected thereby and shall remain in full force and effect to the fullest extent permitted by applicable law.
- Insurance.
Benchspace carries General Liability insurance. As a user, it is strongly suggested that you have your own Insurance policy to cover your own equipment, work and or products while using the space. In addition it is recommended that you carry public and product liability insurance.
